LIABILITY WAIVER AND RELEASE AGREEMENT

This document ("Agreement") is entered into by you and Ruff & Rumble LLC ("Company").
1. AGREEMENT TO PARTICIPATE:
By registering for or attending any class, service, event, or activity provided by Ruff & Rumble LLC (collectively referred to as "Activity"), you acknowledge that your participation is contingent upon agreeing to the terms of this Agreement. Your submission of an RSVP to sign up or attendance at any Activity signifies your acceptance of this Agreement.
2. ACKNOWLEDGEMENT OF RISKS AND LIABILITY RELEASE:
You acknowledge that Ruff & Rumble LLC, including its owners, employees, volunteers, supervisors, facility owners, and other representatives, is not liable for any loss or damage to your personal property during an Activity. You understand that Activities may involve physical exertion and inherent risks, including injury, disability, illness (e.g., COVID-19), property damage, or even death. You voluntarily assume all risks associated with participation, including discomfort, muscle soreness, or, in rare cases, more serious health issues like heart problems. This risk acceptance also applies to the use of any equipment, props, or surroundings involved in the Activity. You agree that Ruff & Rumble LLC including its owners, employees, volunteers, supervisors, facility owners, and any other representatives are not responsible for any injury, loss, or damage to yourself, your dog, or any third party during the Activity. You also take full responsibility for the actions and behavior of you and your dog at all times.
3. RESPONSIBILITY FOR ANIMALS:
You agree to assume full responsibility for any animals you bring to an Activity. You confirm that all animals are properly licensed and vaccinated in accordance with applicable laws. You acknowledge the inherent dangers of interacting with animals, recognizing that even well-trained pets may exhibit unpredictable behaviors, including biting.
4. DOG’S HEALTH & BEHAVIOR:
You acknowledge that Ruff & Rumble LLC, its owners, employees, volunteers, supervisors, facility owners, and any contractors and affiliated parties are not responsible for any pre-existing health conditions or behavioral issues of the dog. You further acknowledge that the Ruff & Rumble LLC reserves the right to refuse or terminate your participation if the dog poses a risk to the safety of the trainers, other owners, or other animals.
5. INDEMNITY AND PROTECTION:
You agree to defend, indemnify, and hold harmless Ruff & Rumble LLC, its owners, employees, volunteers, supervisors, facility owners, and any contractors and affiliated parties, from any claims, damages, or legal actions arising from your participation in any Activity, including those resulting from the negligence of the Company or its owners, employees, volunteers, supervisors, facility owners, and any contractors and affiliated parties. This indemnity includes, but is not limited to, accidents or injuries related to faulty equipment, improper maintenance, inadequate instruction, or slips and falls.
6. ANIMAL SUPERVISION:
You understand that Ruff & Rumble LLC, its owners, employees, volunteers, supervisors, facility owners, and any contractors and affiliated parties are not responsible for overseeing or managing any animals you bring to an Activity.
7. ACKNOWLEDGEMENT OF TERMS:
By signing or participating, you confirm that you have read and understood this Agreement. You agree that any future updates or additions to this Agreement will automatically apply to your participation in Activities.
8. DISCLAIMERS:
Ruff & Rumble LLC is not liable for any inadvertent errors or omissions, nor does it guarantee satisfaction with any recommended products or services.
9. MEDIA RELEASE:
By participating in Activities, you consent to the use of your image, photos, or video recordings for marketing, promotional, or informational purposes by Ruff & Rumble LLC. You waive any right to compensation for such uses and release the Company from any liability related to the creation, processing, or dissemination of this media.
10. ENTIRE AGREEMENT AND SEVERABILITY:
This Agreement represents the complete and exclusive understanding between you and Ruff & Rumble LLC. Should any provision be found unenforceable, the remaining provisions will continue to be in effect.
11. BINDING NATURE:
You affirm that you are over the age of 18 and legally capable of entering into this Agreement. Your RSVP to sign up, attendance at, or participation in any Activity confirms your acceptance of the terms outlined in this document.
